These Terms govern your access to and use of Matjar’s website, waitlist, and marketplace services. By using Matjar, you agree to these Terms and to our Privacy Policy.

1) Who we are

Matjar operates an online marketplace. Unless stated otherwise, merchants are the sellers of record for their products. Matjar provides the platform, payments facilitation through third-party providers, and order tracking.

2) Eligibility & account

• You must be 18+ and able to form a binding contract under UAE law.
• Keep your credentials confidential. You’re responsible for activity on your account.
• We may suspend or terminate accounts that violate these Terms or applicable law.

3) Orders, pricing, and availability

• Placing items in a cart does not reserve them.
• Prices, fees, taxes, and delivery charges are shown at checkout.
• If a pricing or availability error occurs, we may cancel and refund the order.
• Merchants are responsible for product descriptions, regulatory compliance, warranties, and after-sales obligations.

4) Payments

• Payments are processed by third-party payment service providers.
• We do not store full card details.
• Your bank or provider may apply currency conversion or other fees.

5) Delivery & risk

• Delivery is handled by merchants and their logistics partners.
• Risk of loss transfers per merchant policy and applicable law (typically on delivery).

6) Returns, refunds, and cancellations

• Each merchant sets its return/refund policy, subject to UAE consumer protection law.
• Where a refund is approved, it is issued to the original payment method within a reasonable period per provider timelines.
• Digital goods or perishable items may be non-returnable where the law allows.

7) User content (reviews, uploads)

• You grant Matjar a non-exclusive, worldwide license to host, display, and distribute content you submit (e.g., reviews) for service operation and promotion.
• Do not post illegal, defamatory, infringing, or deceptive content. We may remove content at our discretion.

8) Prohibited uses

You agree not to:

• Violate any law or third-party rights.
• Interfere with the platform, misuse coupons, or attempt fraud.
• Scrape, reverse engineer, or access the service via unauthorized means.

9) Intellectual property

• The platform, logos, and software are owned by Matjar or its licensors.
• You may not copy, modify, or create derivative works except as allowed by law.

10) Marketplace role & disputes

• For purchases from third-party merchants, Matjar is an intermediary.
• Product-specific issues (quality, warranty, returns beyond platform rules) are handled with the merchant.
• We may assist but are not a party to the sale unless Matjar is listed as the seller.

11) Warranties & disclaimers

• Services are provided on an “as-is” and “as-available” basis.
• To the maximum extent permitted by UAE law, we disclaim implied warranties (merchantability, fitness for a particular purpose, non-infringement).
• Consumer rights granted by UAE law remain unaffected.

12) Limitation of liability

To the extent allowed by UAE law:

• Matjar will not be liable for indirect, incidental, or consequential damages.
• Our total liability for any claim in the aggregate will not exceed the greater of AED 500 or the fees you paid to Matjar for the transaction giving rise to the claim in the last 3 months.
• Nothing limits liability for death or personal injury caused by negligence, fraud, or where liability cannot be limited by law.

13) Indemnity

You agree to indemnify and hold harmless Matjar from claims arising out of your unlawful use of the service, your content, or your breach of these Terms, to the extent permitted by UAE law.

14) Privacy

Our Privacy Policy explains how we collect and process personal data under UAE PDPL. By using Matjar, you acknowledge that policy.

15) Changes to the service or Terms

We may update features or these Terms. If changes are material, we will give notice (e.g., by email or site notice). Continued use after the effective date means you accept the changes.

16) Suspension and termination

We may suspend or terminate access for suspected fraud, security risks, non-payment, or legal reasons. You may stop using the service at any time. Sections that by nature should survive will continue (e.g., IP, disclaimers, liability, governing law).

17) Governing law & venue

These Terms are governed by UAE law. Disputes are subject to the jurisdiction of the competent courts in the UAE unless a different forum is mandated by law.
